TERMS & CONDITIONS

I. GENRAL PROVISIONS

  1. These terms & conditions shall describe using by Users, including Purchasers, the Shop kept by the Seller.

II. DEFINITIONS

  1. Seller – Kosglobe Patryk Kosinski in the seat in: Narutowicza 89/9, 90-139 Lodz, Poland
    VAT EU PL7252175375

  2. Shop – a collection of web sites and IT tools (web service) managed by the Seller.

  3. Purchaser – a User who has concluded a Sales Agreement as a part of the shop.

  4. Sales Agreement – an agreement concluded in the shop on the terms resulting from these Terms & Conditions between the Seller and the Purchaser, which subject consists in selling items to the benefit of the Purchaser.

  5. Agreement – includes a Sales Agreement and an Agreement on Rendering Services.

 

III. GENERAL TERMS&CONDITIONS OF USING A SHOP

  1. A user who is a natural person may use the Shop provided that he has full capacity to perform acts in laws.

  2. A User who is not a natural person can use the Shop by authorised persons who act on behalf of him, considering provisions included in the SIGNING UP IN THE SHOP section, in paragraph 4.

  3. A User can use the Shop by means of devices which communicate with the Internet (computer, phone), using a web browser.

  4. A user shall be obliged to provide correct, actual and complete details in the forms and shall proceed according to the terms of these Terms & Conditions. Data provided by the User shall not violate applicable law provisions and personal interests and third party rights.

  5. Using by the User a name of the Seller, a logo of the Shop, Materials and other than materials constituents of the Shop (including graphic elements of the Shop and outline and structure of the Shop – a so called layout) shall be forbidden excluding situations explicitly indicated in these Terms & Conditions or when using, mentioned in this paragraph, items, copyrights and items of industrial property shall be possible on the basis of the explicit written consent of the Seller or authorised third party entities.



IV. SIGNING UP IN THE SHOP

  1. Users have a possibility to:

    1. use the Shop, in that concluding Agreements, without a necessity to sign up;

    2. sign up for the Shop using access data of the User (login and password);

  2. It shall be possible to conclude an Agreement without a prior signing up in the Shop:

  3. In the case of any change in User’s personal details provided during signing up, the User should update it before concluding the next Agreement.

  4. Once You sign up, it shall be created a User account in the shop, which shall constitute a set of resources in which are collected information about the User and his/her activities within the Shop with regard to concluded Agreements. As a part of the User’s account shall have an access, among others, an access to a history of his/her orders placed in the Shop.

V. PLACING ORDERS IN THE SHOP – CONCLUDING AN AGREEMENT

  1. After a proper placement of an order, the Seller shall promptly submit the User information about accepting the order (accepting the offer) at the e-mail address entered while placing the order or during a signing up process. An Agreement shall be concluded at the moment of submitting by the Seller information to the User about accepting the Order.

VI. TERMS OF PAYMENT

  1. Payments for purchased goods and rendered services in the Shop (price and delivery costs) shall be made by means of payment tools available in the Shop and on the terms described by the Seller.

  2. The Seller shall reserve a right to change prices and an amount of delivery costs, in particular in the case of an amendment of pricelists of services rendered by entities which realise deliveries.

VII. TERMS OF DELIVERY

  1. A delivery shall be performed at the address specified by the Purchaser.

  2. If the Seller cannot fulfil a service because goods or a service are unavailable, promptly, however not later than within thirty (30) days from concluding the Agreement, the Seller shall notify about that the Purchaser and shall refund full received from him/her amount, if this amount has been paid.

  3. In the case when the Seller cannot fulfil an obligation due at least temporary inability to render a service with properties ordered by a Consumer, the Seller can waive this obligation by fulfilling a substitute service, which is of the same quality and intended use and for the same price and remuneration, informing at the same time the Consumer in the written form about his/her right not to accept this service and withdraw from the Agreement, together with a return items at the Seller’s cost.

VIII. PROTECTION OF PERSONAL DATA

  1. Personal data provided by the Users shall be collected and processed by the Seller according to applicable law provisions and according to the Privacy Policy.
